(1) ACCEPTANCE OF TERMS

By accessing or using HuntingLocator.com ("Hunting Locator," "we," "our," or "us"), you agree to these Terms of Service. If you do not agree, you may not use the platform. Access to and use of this site without your pre-agreement to all of these Terms is unauthorized and may be illegal, give us the right to sue you, or both.

(2) COMPANY & LEGAL STRUCTURE

Hunting Locator is operated by Hunting Locator LLC, a Florida limited liability company. You agree:

• Any legal claims will be brought only against Hunting Locator LLC.
• You will not pursue claims against individual members, employees, or agents.

(3) NATURE OF THE PLATFORM

Hunting Locator is a marketplace only. We:

• Connect hunters and landowners.
• Do not verify listings.
• Do not participate in leases.
• Do not handle payments between users.

All listings function similarly to classified advertisements.

(4) ACCOUNTS & ELIGIBILITY

• Must be 18 or older to purchase a membership.
• Must be 13 or older to use the site.
• You are responsible for all activity under your account.
• Accounts may not be shared. Sharing your account will result in termination.

(5) MEMBERSHIP & BILLING

Your membership, billing terms, and auto-renewal policy are described in this section. By clicking "Message Landowner" or completing a purchase, you confirm you have read and agree to these terms.

Free Trial

• 7-day free trial available upon sign-up.
• No messaging access during the free trial period.

Paid Membership
A paid membership is required to contact landowners or view their contact information.

Billing Trigger
Clicking "Message Landowner": This action immediately upgrades your account to a paid membership and authorizes payment — even if you are currently in a free trial. By clicking this button, you consent to the immediate charge to your payment method on file.

• Your account will immediately upgrade to a paid membership.
• Payment is authorized and processed immediately, even during a trial period.
• No additional confirmation step will occur before your card is charged.

Auto-Renewal
YOUR MEMBERSHIP AUTOMATICALLY RENEWS. By purchasing a membership you expressly authorize Hunting Locator to charge your payment method on a recurring basis until you cancel:

• Memberships automatically renew at the end of each billing period.
• No advance notice of renewal will be provided unless required by law.
• Renewal price will be the same as your current rate unless otherwise stated.
• To cancel, log in to your account and select "Edit your premium membership" before your renewal date.

Cancellation Policy
Members may cancel their subscription at any time prior to the next billing date through their account settings or by contacting Hunting Locator through an official written support channel. Cancellation requests must be received and successfully processed before the renewal date to avoid future charges.

Upon cancellation, the membership will remain active through the end of the current billing period unless otherwise stated. No partial-period refunds or prorated credits will be issued for unused time remaining in an active subscription term unless required by law or expressly approved by Hunting Locator.

Hunting Locator may provide customer service telephone numbers for general support purposes; however, leaving a voicemail, missed call, or verbal message at any published phone number does not constitute cancellation of a membership or subscription. To ensure accurate processing and verification, cancellation requests must be submitted through the user account cancellation process or through the official written support channels designated by Hunting Locator.

Customers are responsible for ensuring that they receive confirmation of cancellation. Failure to receive a cancellation confirmation indicates that the cancellation request was not completed successfully, and the membership may remain active and continue billing. Hunting Locator is not responsible for failed, incomplete, interrupted, or unverified cancellation attempts made through unofficial or unsupported methods.

Deleting the mobile application, logging out of an account, discontinuing use of the service, or ceasing communication with landowners does not automatically cancel a subscription or recurring billing authorization.

If a member believes they were billed in error, they must contact Hunting Locator directly prior to initiating a chargeback or payment dispute so the issue may be reviewed and addressed. Unauthorized or improper chargebacks submitted for valid charges may result in account suspension or permanent termination of access to Hunting Locator services.

(6) REFUND POLICY

• A full refund may be issued within 30 days ONLY if no messaging has been used.
• If messaging has been used:
  • Refunds are not guaranteed.
  • Partial refunds may be issued at our sole discretion.
• All refund decisions are made on a case-by-case basis. Contact [email protected] to submit a refund request.

(7) LISTINGS & THIRD-PARTY RISK

• All listings are user-generated content.
• We do not verify ownership, availability, or accuracy of any listing.
• Listings may be fraudulent, outdated, or inaccurate.
• You must perform your own due diligence before acting on any listing.

User Reporting Obligation: If you come across material on this site that you believe to be inaccurate, misleading, or otherwise improper, you must notify us at [email protected] within 30 days of viewing it, providing a description of the material and a copy where possible. Failure to report known inaccuracies within this window waives any related claim against Hunting Locator arising from that material.

(8) NO GUARANTEES

We do not guarantee:

• Landowner response.
• Lease availability.
• Listing accuracy.
• Successful outcomes of any kind.

(9) USER RESPONSIBILITY

You agree:

• You are solely responsible for all decisions made using the platform.
• You assume all risk related to financial transactions, property access, and hunting activities.

(10) FRAUD WARNING

• Some users may act fraudulently.
• Hunting Locator is not liable for fraud or misrepresentation by third parties.

(11) LIMITATION OF LIABILITY

To the fullest extent allowed by law:

• Your maximum recovery is limited to the amount paid to Hunting Locator in the past 12 months.
• We are not liable for indirect damages, lost money, injury, or property damage.

WE SPECIFICALLY DISCLAIM WARRANTIES. HUNTINGLOCATOR.COM AND ALL INFORMATION, PRODUCTS, AND SERVICES AVAILABLE THROUGH IT ARE MADE AVAILABLE TO YOU ON AN "AS IS" BASIS, "WITH ALL FAULTS," AND ONLY "AS AVAILABLE." WE DO NOT GUARANTEE ANYTHING LISTED OR OFFERED THROUGH THE SITE. THIS DISCLAIMER APPLIES TO ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

(12) INDEMNIFICATION

You agree to fully indemnify Hunting Locator against any legal claims, damages, and attorney fees resulting from your use of the platform, your listings, or your actions.

IF SOMEONE ELSE SUES US BECAUSE OF SOMETHING YOU ARE ALLEGED TO HAVE DONE OR FAILED TO DO, YOU AGREE TO INDEMNIFY US FULLY FROM ANY COSTS OF DEFENSE, SETTLEMENTS, JUDGMENTS, AND OTHER EXPENSES AND PAYMENTS. FOR EXAMPLE, IF WE ARE SUED BECAUSE OF THE INACCURACIES OR INAPPROPRIATENESS OF YOUR LISTING, OR BECAUSE YOU FAILED TO MAKE PAYMENT FOR USE OF A LISTED PROPERTY, YOU WILL END UP PAYING ALL THE COSTS AND EXPENSES WE INCUR AS RESULT, EVEN THOUGH WE WILL USE LAWYERS OF OUR OWN CHOOSING TO DEFEND US. THIS EXTENDS EVEN TO OUR LEGAL FEES OR ANY AMOUNT WE MIGHT PAY AS THE RESULT OF A SETTLEMENT OR A JUDGMENT. YOU ALSO AGREE TO PAY ANY LEGAL FEES AND COSTS WE INCUR IN ATTEMPTING TO GET YOU TO COMPLY WITH THESE INDEMNIFICATION PROVISIONS.

(13) PROHIBITED USE

You may not:

• Misrepresent your identity or listings.
• Harass or spam other users.
• Scrape or copy listings.

Unauthorized Access: Access to and use of this site without your pre-agreement to all of these Terms is unauthorized and may be illegal, give us the right to sue you, or both. For example, the federal Computer Fraud and Abuse Act, 18 U.S.C. §1030, makes unauthorized use and access a crime. This applies to scraping, credential abuse, automated access, and any other unauthorized use of platform data or systems.

Competitive Use & Non-Solicitation
You may not use the Hunting Locator platform for any purpose other than its intended use as a marketplace connecting hunters and landowners. Specifically, you agree not to:

• Solicit, recruit, or otherwise contact landowners or users for the purpose of promoting or building a competing service, platform, or business.
• Attempt to establish independent relationships with landowners for commercial purposes outside the normal use of the platform in a way that circumvents Hunting Locator.
• Copy, collect, or compile listings, user information, or contact details for use in another service or database.
• Send bulk, repetitive, or unsolicited messages to landowners or users, including messages intended to redirect them off the platform.

Any attempt to use Hunting Locator to compete with, replicate, or undermine the platform's business model is strictly prohibited. Hunting Locator reserves the right to suspend or terminate any account engaged in such activity, remove associated content or communications, deny refunds, and pursue any other remedies available under applicable law.

Liquidated Damages:

• $500 per scraped user or listing.
• An additional $500 per each use of scraped data.

(14) INTELLECTUAL PROPERTY

Limited License: Based on your agreement to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use this site solely for its intended purpose as a hunting lease marketplace. This license does not transfer any ownership rights. Any use of this site outside the scope of this license is a violation of these Terms and may result in termination of your account and legal action.

• All site content belongs to Hunting Locator or its licensors.
• You may not reproduce or distribute site content without written permission.

User Content: By submitting content to the platform, you grant Hunting Locator a non-exclusive right to use, modify, and display that content.

(15) MONITORING

We reserve the right to:

• Monitor platform activity.
• Investigate suspected misuse.
• Access communications if necessary to investigate violations of these Terms.

(16) ACCOUNT TERMINATION

We may, at any time and without notice:

• Suspend or terminate accounts.
• Remove listings.
• Deny access to this website or any service provided through it to anyone who we believe to have violated, or who we expect to violate, these Terms, or who in our judgment interferes with the ability of others to enjoy this website, or infringes the rights of others, or for any other reason not specifically prohibited by law.

If we decide to limit your access, we do not have to explain why.

(17) NO ACCOUNT SHARING

• Accounts are personal and non-transferable.
• Sharing your account credentials with others will result in account termination.

(18) PRIVACY

This section is a summary only. Our full Privacy Policy governs how we collect and use your data and is available at huntinglocator.com/privacy-policy. In the event of any conflict between this summary and the full Privacy Policy, the full Privacy Policy controls.

We collect:

• Contact information.
• Payment information.
• Usage data, including IP addresses and browsing behavior on the platform.

We may:

• Use third-party services to process or store data.
• We are not liable for data breaches caused by third-party service providers.

Investigative Data Collection: We may collect your IP address as part of analyzing website usage and traffic patterns. We may conduct a WHOIS lookup or reverse IP identification if in our judgment you appear to be attempting to misuse the website, scrape data, or otherwise violate these Terms.

(19) GOVERNING LAW

• Florida law applies to these Terms of Service.
• Venue for any legal proceedings shall be Florida courts in the Bradenton area.

(20) DISPUTES

• Disputes must be reported to us within 30 days of the event giving rise to the dispute.
• You agree not to include Hunting Locator in third-party disputes unrelated to your use of the platform.

(21) CHANGES TO TERMS

We may update these Terms at any time without advance notice, for reasons such as the evolving nature of the internet, legal changes, or user feedback. Each new visit or use of the site constitutes agreement to the latest version of this page. Looking at the effective date above may help you determine if you need to review this page again for changes. Continued use of the platform following any changes constitutes your acceptance of the updated Terms.

(23) INTERPRETATION & CONSTRUCTION

The organization, headings, and formatting of these Terms are for readability and convenience only and do not limit the scope or meaning of any provision. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms represent the entire agreement between you and Hunting Locator regarding your use of the platform and supersede any prior agreements on the same subject matter.
